Court Says CFTC Actions in Separate Matter Have “No Relevance” to Gemini Lawsuit
br>On Friday, July 19, 2024, Judge Alvin K. Hellerstein of the United States District Court for the Southern District of New York denied Gemini Trust Company’s request to take into account alleged contradictory positions by the U.S. Commodity Futures Trading Commission in a separate enforcement action.
Gemini, the crypto exchange founded by Tyler and Cameron Winklevoss, is facing a lawsuit from the CFTC over its proposed bitcoin futures contract. The CFTC accuses Gemini of omitting critical information in its application that could impact whether the contract was susceptible to manipulation.
Gemini had asked Judge Hellerstein to consider allegations that the CFTC took contradictory stances in its case against foreign exchange firm Traders Global and its CEO Murtuza Kazmi. In that case, the CFTC admitted to misrepresenting certain evidence but argued the court did not rely on the incorrect information. Gemini claimed this contradicted the CFTC’s blocking of similar discovery efforts in its own case.
However, Judge Hellerstein ruled that the two matters were unrelated and the CFTC’s alleged contradictory positions in the Traders Global case have “no relevance” to the case against Gemini. He stated that Gemini’s application to broaden proceedings in this manner would “confuse, complicate, and needlessly extend” the case without providing useful information.
The judge rejected Gemini’s argument that the CFTC was seeking a “two-tiered system of justice” by treating the exchange differently than Traders Global. He noted the key differences between misrepresenting evidence of fund transfers, as in the other case, versus Gemini’s alleged misstatements during the self-certification process for the bitcoin futures contract.
The CFTC sued Gemini in June 2022 over 31 statements it claimed were misleading regarding procedures like self-trading prevention that could impact the contract. Both sides have now briefed the court on partial summary judgment motions.
