Crypto Firm B2C2 Denies Allegations in Bradley Nagela’s Employment Lawsuit

On Tuesday, December 3, 2024, B2C2 USA and B2C2 Ltd. filed an answer in the US District Court for the District of New Jersey in response to a lawsuit brought by former employee Bradley Nagela. The case revolves around allegations of unlawful retaliation and other claims linked to Nagela’s employment and subsequent termination.

Nagela, a former employee of B2C2 USA and the Global Head of Options Trading for the Americas, claims he was fired in retaliation for reporting inappropriate behavior by Phillip Gillespie, Co-CEO of B2C2 Ltd., during the 2022 Miami Bitcoin Conference. He alleges that Gillespie was consuming excessive alcohol and using illegal drugs, including cocaine and hallucinogens, at the event, which raised concerns for the safety of a 19-year-old female intern who was exposed to his actions.

After reporting Gillespie’s conduct to his supervisors, Nagela asserts that he faced retaliation, culminating in his termination about four months later. Despite Nagela’s attempts to address the issue, Gillespie was promoted to Sole Global Chief Executive Officer of B2C2. The lawsuit claims that B2C2 management was aware of Gillespie’s behavior but chose to ignore it, referencing a letter from a concerned parent fearing for their daughter’s safety at the conference as evidence of prior knowledge.

In their response, the B2C2 Defendants categorically denied many of the allegations made by Nagela, asserting a general denial of the claims presented in the First Amended Complaint. They emphasized that they deny any assertion that Nagela suffered damages due to their conduct. The defendants stated that their answers are based on their current knowledge and reserve the right to amend their responses as new information becomes available.

The answer outlines specific denials and admissions regarding various paragraphs of the Amended Complaint. For instance, B2C2 admitted that Nagela was employed as the Global Head of Options Trading from March 2021 until his separation in September 2022. They also confirmed that he contributed to the development of a risk management system. However, numerous allegations were met with denials, particularly those related to the circumstances surrounding his employment and termination.

B2C2’s answer includes responses to allegations concerning the roles of various individuals within the company. They acknowledged that Nagela reported to Robert Catalanello during part of his employment and that Nicola White was his direct supervisor during the latter portion. Additionally, they admitted to the existence of an email received from an individual named Aroon Chen regarding the Miami 2022 Bitcoin Conference, which is also referenced in the complaint.

The lawsuit includes claims of retaliation based on Nagela’s engagement in protected activities, asserting violations of the New Jersey Law Against Discrimination (NJLAD) and the New Jersey Conscientious Employee Protection Act (CEPA). The B2C2 Defendants’ response indicates that they believe the claims lack merit. They assert that the Amended Complaint fails to state a valid claim for relief and argue that any damages Nagela claims were a result of his own conduct rather than any wrongful action on their part.

In their affirmative defenses, the B2C2 Defendants outlined several legal arguments. They claim that Nagela’s allegations do not confer jurisdiction upon one or more of the defendants and that the conduct attributed to them was justified and performed in good faith. They further contend that Nagela’s claims are barred by principles of waiver, laches, or estoppel, and assert that he did not mitigate his damages.

The response also notes that while Nagela may claim damages for physical or emotional injuries connected to his employment, such claims should be governed exclusively by the New Jersey Workers’ Compensation Act. The B2C2 Defendants maintain that they acted without malice and that their actions were justified under the circumstances.

As the case progresses, the B2C2 Defendants have reserved the right to assert additional defenses that may arise during the discovery process. The court proceedings will continue as both parties prepare for further legal developments.
