EZ Blockchain Seeks Default Judgment Against Jaguar Cryptocurrency in Delaware Court

On Thursday, September 19, 2024, crypto mining firm EZ Blockchain Products LLC filed a motion for default judgment in the Delaware Superior Court, New Castle County, against Jaguar Cryptocurrency LLC. The case stems from allegations of breach of contract related to a sales agreement between the two parties.

According to the motion, EZ Blockchain Products claims that Jaguar Cryptocurrency failed to fulfill its obligation to pay a total of $1,355,000. This amount was stipulated in a written agreement prior to the dispute. The Plaintiff initially filed a complaint on July 28, 2023, outlining the details of the alleged breach and seeking compensation for the unpaid amount.

The legal process began when a summons and the complaint were served on the Defendant, Jaguar Cryptocurrency, on November 6, 2023. The service was conducted via certified mail with a return receipt requested, in accordance with Delaware law, specifically under 10 Del. C. §3104. The Defendant was given until November 27, 2023, to respond to the complaint; however, as of the date of the recent motion, Jaguar Cryptocurrency had not appeared in court, filed an answer, or otherwise responded to the allegations.

In support of its motion for default judgment, EZ Blockchain Products indicated that a copy of the motion has been mailed to Jaguar Cryptocurrency at the same address where the initial complaint was served. The Plaintiff’s motion cites Rule 55(b)(2) of the Superior Court Rules of Civil Procedure, which allows for a judgment by default when a party fails to respond to a complaint.

EZ Blockchain Products is now requesting that the Court enter a judgment by default against Jaguar Cryptocurrency and set a date for an inquisition hearing. The purpose of this hearing would be to assess the extent of the damages incurred by the Plaintiff as a result of the alleged contract breach.

The motion for default judgment emphasizes the Plaintiff’s position and aims to expedite the judicial process to recover the owed funds.
