North Tonawanda Residents Sue Crypto Mining Firm Digi Power Over Noise Pollution

On Monday, April 6, 2026, Sharon Demers, Mark Polito, and Karen Hance filed a complaint in the US District Court for the Western District of New York against Digi Power X Inc., a cryptocurrency mining company, alleging noise pollution and its detrimental effects on their community of North Tonawanda, New York. The plaintiffs are seeking damages and a jury trial.

The lawsuit claims that since early 2021, when Digi Power purchased a local gas power plant to expand its Bitcoin mining operations, the lives of nearby residents have been significantly disrupted. Digi Power installed thousands of high-processing, energy-intensive computers that operate nearly 24/7, generating constant noise and low-frequency vibrations. The plaintiffs contend that this has resulted in substantial annoyance, emotional distress, loss of comfort and enjoyment, diminished property values, and increased risk of adverse health effects.

According to the complaint, the noise and vibrations are pervasive, inescapable, and unbearable, interfering with residents’ ability to sleep, hold conversations, relax, and enjoy their properties. The plaintiffs state that before Digi Power’s operations began, North Tonawanda was a peaceful residential area with low ambient noise levels.

The lawsuit asserts that Digi Power was aware of the potential noise impact but falsely represented that no noise would escape its facility. The plaintiffs claim that the company made no attempts to study or mitigate the noise and vibration impact on the surrounding community. Despite residents’ concerns, Digi Power installed a 26-foot acoustic wall in 2023, which plaintiffs describe as ineffective.

The plaintiffs allege that the noise levels from Digi Power’s facility repeatedly exceed permissible decibel levels under the City’s ordinance. The city has issued multiple citations to Digi Power for violating the Noise Ordinance, but the case remains pending.

The plaintiffs are seeking class-action status, representing all individuals residing on property located within three miles of Digi Power’s facility from 2021 to the present, as well as those who own or owned real property within that radius. They are claiming the facility is a private and public nuisance and are citing negligence and negligent infliction of emotional distress.

The plaintiffs are asking the court to award damages, including compensation for personal injuries, property damage, and loss of enjoyment, as well as injunctive relief to abate the nuisance and establish a medical monitoring program for affected residents.
