Real Estate CEO Sues Alleged Crypto Scammer for Defamation
br>On Thursday, August 29, 2024, Scott Everett filed a complaint in the US District Court for the Northern District of Texas against Jakub Kostecki. Everett alleged that Kostecki defamed him through a social media account called “LPWhisperer.”
Everett is the founder and CEO of S2 Capital, a Dallas-based real estate investment firm. The complaint states that since founding S2 Capital in 2012, Everett has grown the company into a successful multifamily investment platform that has acquired over 46,000 apartment units across the United States. However, Kostecki began targeting Everett and S2 Capital earlier this year through his LPWhisperer account on the social network X, making false claims that Everett stole money from investors and engaged in other criminal acts.
The complaint provides extensive details about Kostecki’s history of alleged fraudulent activities. Polish court records indicate that Kostecki was convicted of crimes in Poland over a decade ago related to scamming venture capitalists. He reportedly pretended to have connections in Silicon Valley and charged fees to arrange meetings, but never delivered on his promises. Kostecki then fled Poland to avoid arrest and continued his schemes in the United States.
In the U.S., Kostecki is accused of organizing a fake cryptocurrency conference called “Massive Adoption” in 2019, selling over 2,000 tickets for thousands of dollars each before canceling the event and pocketing the funds. He also allegedly created a fraudulent charity called “#SatsforStudents” that claimed to support cryptocurrency education for children but instead saw donations drained from its cryptocurrency wallets. Court documents show that Kostecki previously defaulted on a civil judgment relating to one of his past cryptocurrency scams.
The complaint charges that through his LPWhisperer account, Kostecki purposefully made individuals the target of unwarranted negative attention with the goal of later extorting them for money. Specifically regarding Everett, Kostecki is accused of escalating his attacks over months, going as far as to post personal photos of Everett and his home alongside false claims of criminal behavior. Everett maintains that Kostecki’s accusations are entirely fabricated and asserts that this defamation has significantly harmed his reputation.
As the complaint was filed in Texas, where Everett lives and S2 Capital is headquartered, it argues the court has jurisdiction over Kostecki, a resident of Colorado. Everett is seeking undisclosed damages for harm to his business and restoration of his reputation, as well as a determination of Kostecki’s liability for defamation.
